Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Atelier Maren website and the purchase of our products and services. By accessing our website or placing an order, you agree to be bound by these Terms.

2. Products and Uniqueness

Every bag created by Atelier Maren is one of a kind, crafted from vintage, reclaimed, or customer-provided fabrics. Due to the unique nature of our products, colours, textures, and patterns may vary from photographs. Minor variations are inherent to handcrafted items made from vintage materials and are not considered defects.

3. Orders and Payment

3.1 Ready-made bags

When you purchase a ready-made bag, payment is processed securely through Stripe at the time of checkout. Once payment is confirmed, the item is reserved exclusively for you and marked as sold. Our atelier will contact you within 48 hours to confirm your order details and arrange shipping.

3.2 Pricing

All prices are displayed in the currency shown on the product page. Shipping costs are arranged separately with the atelier after purchase and are not included in the listed price.

4. Custom Orders

4.1 Consultation process

The custom order consultation form on our website is the beginning of a conversation, not a binding commitment. Submitting a consultation does not constitute an order or create any obligation on either party. We will review your submission and respond within 48 hours with our thoughts, ideas, and a quote.

4.2 Your fabrics

If you choose to send us your personal fabric for a custom order, you acknowledge and agree to the following:

You confirm that you are the rightful owner of the fabric or have authorisation to have it transformed. You understand that the process of cutting and sewing fabric into a bag is irreversible. Once your fabric has been cut, it cannot be restored to its original form. While we take the utmost care with every fabric entrusted to us, we cannot guarantee against all risks during the crafting process, including but not limited to: minor fraying or distress inherent to vintage materials, slight colour variations that may occur during handling, and unforeseen fragility in aged or delicate textiles.

4.3 Liability for customer fabrics

Atelier Maren exercises professional care and skill in handling your fabrics. However, given the often vintage, aged, or delicate nature of customer-provided fabrics, our liability is limited as follows:

We are not liable for pre-existing damage, fragility, or deterioration in the fabric that becomes apparent during the crafting process. We are not liable for fabric characteristics that make it unsuitable for bag construction, though we will advise you if we identify concerns before beginning work. In the unlikely event of damage caused by our negligence during the crafting process, our liability is limited to the agreed cost of the custom order. We strongly recommend that you retain photographs of your fabric before sending it to us.

4.4 Custom order pricing and payment

A detailed quote will be provided after the initial consultation. Custom orders require a deposit before work begins, with the balance due upon completion. Specific payment terms will be agreed upon individually for each project.

4.5 Cancellation of custom orders

Custom orders may be cancelled before work has begun, in which case any deposit will be refunded in full. Once cutting or sewing has commenced, the order cannot be cancelled and the deposit is non-refundable, as the work performed and materials used cannot be reversed.

4.6 Shipping costs for custom orders

Shipping costs are quoted separately from the price of the custom order and may vary from any estimates provided at the time of consultation or quoting, due to factors such as destination, carrier availability, insurance requirements, and package dimensions. Shipping costs are confirmed at the time of dispatch.

If you decline to pay the confirmed shipping costs once your custom order has been completed, you remain liable for the full agreed price of the item. Completed custom orders that are not collected or shipped within 30 days of completion due to a dispute over shipping costs will be subject to a storage fee, and Atelier Maren reserves the right to recover the full order amount.

5. Shipping and Delivery

Shipping is arranged personally with each customer after purchase. We ship worldwide with full insurance. The specific shipping method, cost, and timeline will be discussed and agreed upon during our post-purchase conversation. Risk of loss passes to you upon delivery to the carrier.

6. Returns and Refunds

Due to the one-of-a-kind nature of our products, we do not accept returns or offer refunds for change of mind. If your item arrives damaged during shipping, please contact us within 48 hours of delivery with photographs of the damage. We will work with you and the shipping carrier to resolve the issue.

Custom orders are non-refundable once work has commenced, as described in section 4.5.

7. Intellectual Property

All designs, photographs, text, and other content on this website are the property of Atelier Maren and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

When we create a custom bag from your fabric, the design of the bag remains our intellectual property. We reserve the right to photograph completed pieces for our portfolio unless you request otherwise in writing.

8. Fabric Exclusivity

When you choose to reserve a curated fabric exclusively during the consultation process, that fabric will not be used for any other customer’s order. The exclusivity reservation is confirmed only after we have acknowledged it in writing and the agreed deposit has been received.

9. Limitation of Liability

To the maximum extent permitted by law, Atelier Maren’s total liability to you for any claim arising from or relating to these Terms or our products shall not exceed the amount you paid for the specific product or service giving rise to the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of sentimental value associated with customer-provided fabrics.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of France.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
